Van Dyke attorney seek news reports in change of venue plan

CHICAGO (AP) — An attorney for a white Chicago police officer charged with murder in the 2014 shooting death of a black teenager has subpoenaed three newspapers for their published reports.

Jason Van Dyke’s attorney, Dan Herbert, said Thursday he is seeking the news stories to support a motion for a change of venue.

Van Dyke is charged in the shooting death of Laquan McDonald. Dashcam video released in 2015 showed the officer shooting the 17-year-old McDonald 16 times. Video of the shooting sparked numerous protests.

Herbert subpoenaed the Daily Herald in Arlington Heights; the Chicago Sun-Times and the Chicago Tribune.

In addition to the news coverage, Herbert also has said a change of venue was necessary because of comments Mayor Rahm Emanuel made about Van Dyke.

Herbert has yet to formally file a motion seeking a change of venue. When he does, Cook County Judge Vincent Gaughan will rule on the merits.
