Barr reverses 2018 immigration board ruling

Individuals with a family member who qualifies to seek asylum will no longer automatically qualify themselves.

On Monday, US Attorney General Bill Barr overturned a 2018 ruling by the immigration board. He concluded that it wasn’t in line with US law which allows claims if someone is persecuted on the basis of race, religion, nationality, or belonging to a certain social group or political persuasion.

The 2018 ruling allowed a son to seek asylum because his father was being targeted.

According to Barr’s ruling, a family group doesn’t constitute “a particular social group unless it has been shown to be socially distinct in the eyes of its society, not just those of its alleged persecutor.”
