New Jersey Superior Court Judge John Russo Jr. suggested an alleged rape victim “close her legs.” Now his attorney suggests the judge is “remorseful.”

Russo denied the woman a restraining order and asked if she knew how to “stop somebody” from having sex with her. When she offered, among other answers, “tell them to stop,” he asked “What else? … Block your body parts? … Close your legs? … Call the police? … Did you do any of those things?”

An advisory panel, in April, suspended Russo for three months. He was before the Supreme Court Tuesday – the justices deciding how to discipline the judge, the Associated Press reports.

He’s also accused of other unethical practices related to failing to recuse himself from other cases and is facing a sexual harassment and discrimination suit filed by a former clerk.
